1. Acceptance of Terms

Welcome to StageInSeconds.com (the "Service," "Platform," "we," "us," or "our"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and StageInSeconds.com governing your access to and use of our AI-powered virtual staging service for real estate professionals.

By accessing, browsing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes. We will notify you of material changes by posting an updated version on our website and updating the "Last Updated" date.

2. Description of Service

StageInSeconds.com provides an AI-powered virtual staging service designed specifically for real estate agents, photographers, property managers, and related professionals. Our Service allows you to:

• Upload photographs of empty or unfurnished rooms
• Generate virtually staged images with AI-generated furniture and decor using Google Gemini API
• Download high-resolution staged images with MLS-compliant watermarks
• Regenerate variations of staged images (up to 10 free variations per credit used)
• Request custom modifications through text prompts (e.g., "remove ceiling fan," "add floor lamp")

Service Limitations: Our AI technology generates photorealistic furniture and decor but does not modify room structure, including walls, windows, floors, or ceilings. The Service is dependent on third-party APIs and services, including Google Gemini API, Firebase, Stripe, and Vercel hosting infrastructure.

3. Account Registration and Eligibility

3.1 Age and Authority Requirements

You must be at least 18 years of age to create an account and use the Service. By registering for an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into binding contracts
• All registration information you provide is accurate, complete, and current
• If registering on behalf of a business entity, you have the authority to bind that entity to these Terms

3.2 Account Registration

To access certain features of the Service, you must create an account by providing:

• A valid email address
• Authentication through Firebase Authentication (email/password or third-party providers)
• Optional: Display name and profile photo

3.3 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach
• Ensuring that you log out from your account at the end of each session

We are not liable for any loss or damage arising from your failure to comply with these security obligations. You agree not to share your account credentials with any third party or allow others to access your account.

4. Payment Terms and Credit System

4.1 Credit-Based Pricing

The Service operates on a credit-based system. One (1) credit allows you to generate one (1) virtually staged image, plus up to ten (10) free regeneration variations of that image.

Credit Packages:

• Single Credit: $15 for 1 credit (pay-as-you-go)
• Standard Pack: $65 for 5 credits (13% savings)
• Professional Pack: $110 for 10 credits (best value)
• Agency Subscription: $199/month for 100 credits per month (subject to Fair Use Policy)

All prices are in United States Dollars (USD) and exclude applicable taxes.

4.2 Payment Processing

All payments are processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your complete payment card information on our servers. Payment information is transmitted directly to and stored by Stripe in accordance with PCI DSS compliance standards.

4.3 Billing and Charges

• One-Time Purchases: Credit packs are charged immediately upon purchase and credits are added to your account instantly
• Subscription Billing: Agency Subscriptions are billed monthly on a recurring basis on the same day each month
• You authorize us (through Stripe) to charge your designated payment method for all fees incurred
• If payment fails, we may suspend your access to the Service until payment is received

4.4 Taxes

You are responsible for all applicable federal, state, local, and foreign taxes, duties, and governmental assessments associated with your use of the Service, except for taxes based on our net income.

5. Subscription Terms (Agency Plan)

5.1 Agency Subscription Details

The Agency Subscription provides 100 credits per calendar month for $199/month, subject to our Fair Use Policy. This subscription:

• Automatically renews on a monthly basis until canceled
• Credits reset on your billing date each month
• Unused credits from previous months do not roll over to subsequent months
• Includes all standard Service features and benefits

5.2 Fair Use Policy

The 100-credit monthly allocation is subject to fair use guidelines designed to ensure reasonable and equitable use of Service resources. Fair use is defined as:

• Using credits for legitimate real estate virtual staging purposes
• Average usage patterns consistent with professional real estate marketing activities
• Usage not exceeding 100 stagings per calendar month under normal circumstances

We reserve the right to review accounts that significantly and consistently exceed the 100-credit monthly allocation or exhibit usage patterns that suggest abuse, resale, or commercial redistribution of the Service. We will contact you before taking any action regarding potential Fair Use Policy violations.

5.3 Automatic Renewal

Your Agency Subscription will automatically renew each month on your billing date unless you cancel before the renewal date. You will be charged the then-current subscription rate. We will notify you of any price increases at least 30 days in advance.

5.4 Cancellation

You may cancel your Agency Subscription at any time through your account settings or by contacting our support team at support@stageinseconds.com. Cancellation takes effect at the end of your current billing period. You will retain access to your subscription benefits until the end of the paid period. No partial refunds are provided for subscription cancellations.

6. Refund and Cancellation Policy

6.1 Digital Goods Policy

The Service provides digital goods (AI-generated images) that are delivered instantly and electronically upon generation. Due to the immediate nature of digital content delivery and the computational resources required to generate each staged image:

All sales of credits and generated images are final and non-refundable.

6.2 Exceptions

We may, at our sole discretion, provide refunds or credits in the following limited circumstances:

• Duplicate Charges: If you are charged multiple times for the same purchase due to a technical error
• Technical Failure: If our Service fails to deliver a generated image due to a technical issue on our end and we are unable to successfully regenerate the image after reasonable attempts
• Billing Errors: If you are charged an incorrect amount due to a system error

6.3 Refund Request Process

To request a refund under the exceptions listed above, you must:

• Contact support@stageinseconds.com within 7 days of the charge
• Provide your account email, transaction ID, and detailed description of the issue
• Provide supporting documentation or screenshots if applicable

Approved refunds will be issued to the original payment method within 5-10 business days.

6.4 No Refund Circumstances

Refunds will not be provided for:

• Dissatisfaction with AI-generated image quality or aesthetic preferences
• User error in uploading images or providing prompts
• Changes in business needs or inability to use the Service
• Unused credits upon account deletion or termination
• Subscription cancellations (you retain access through the end of your billing period)
• Issues arising from third-party service failures beyond our reasonable control

6.5 Credit Expiration

• One-Time Purchase Credits: Credits purchased through one-time credit packs do not expire and remain in your account until used or your account is terminated
• Subscription Credits: Monthly subscription credits expire at the end of each billing period and do not roll over to the next month

7. User Content and Intellectual Property

7.1 Your Uploaded Content

You retain all ownership rights to photographs and images you upload to the Service ("User Content"). By uploading User Content, you represent and warrant that:

• You own all rights to the User Content or have obtained all necessary permissions, licenses, consents, and releases to upload and use it
• Your User Content does not infringe, violate, or misappropriate any third-party rights, including copyright, trademark, patent, trade secret, moral rights, privacy rights, or publicity rights
• Your User Content does not contain illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable material

7.2 License to Process User Content

By uploading User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to use, store, reproduce, modify, and process your User Content solely for the purposes of:

• Providing the Service and generating virtually staged images
• Transmitting your User Content to third-party AI services (Google Gemini API) for processing
• Storing your User Content in Firebase Storage
• Technical operations, including backup and security measures

This license terminates when you delete your User Content or your account, except for copies retained in our backup systems for a reasonable period not to exceed 90 days.

7.3 Ownership of AI-Generated Images

User Ownership: You own all rights, title, and interest in and to the AI-generated virtually staged images created through your use of the Service using your credits ("Generated Images").

Our Limited Rights: We do not claim ownership of your Generated Images. However, due to the nature of AI technology, similar or substantially similar images may be generated for other users based on similar inputs.

7.4 Commercial License

Upon successful generation and delivery of Generated Images, we grant you a perpetual, irrevocable, worldwide, royalty-free, exclusive (subject to the similarity exception above), transferable, sublicensable commercial license to use, reproduce, modify, distribute, display, perform, and create derivative works from your Generated Images for any lawful purpose, including:

• Real estate marketing and advertising
• MLS listings and property promotion
• Commercial marketing materials
• Social media and digital marketing
• Print and digital publications

7.5 Watermark Requirement

All Generated Images include a "Virtually Staged" watermark to comply with MLS disclosure requirements and industry best practices. You agree not to remove, obscure, or alter this watermark when using Generated Images for real estate marketing purposes or MLS listings. You may remove the watermark for other lawful uses at your discretion, but you remain responsible for compliance with all applicable disclosure requirements.

8. Acceptable Use Policy and Prohibited Conduct

8.1 Permitted Uses

You may use the Service only for lawful purposes and in accordance with these Terms. Permitted uses include:

• Legitimate real estate virtual staging for property marketing
• Creating marketing materials for real estate listings
• Generating visualization content for real estate professionals
• Professional photography and property presentation services

8.2 Prohibited Uses

You agree not to:

Content Violations:

• Upload User Content that you do not own or have permission to use
• Upload copyrighted images, photographs, or materials without proper authorization
• Upload content containing illegal material, obscene content, or material depicting minors
• Upload content that violates any third-party intellectual property, privacy, or publicity rights

Misrepresentation and Fraud:

• Use Generated Images to materially misrepresent the actual condition, features, layout, or characteristics of a property
• Alter room structure, dimensions, or permanent features in ways that create false impressions
• Use the Service to create deceptive, fraudulent, or misleading property representations
• Violate fair housing laws or include discriminatory elements in staging

System Abuse:

• Attempt to circumvent, disable, or interfere with security features of the Service
• Use automated scripts, bots, or other automated means to access the Service without authorization
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Engage in any activity that disrupts or interferes with the Service or servers/networks connected to the Service

Commercial Abuse:

• Resell, redistribute, or sublicense access to the Service without our prior written consent
• Use the Service to provide virtual staging services to third parties as a white-label solution
• Exceed fair use limits on Agency Subscriptions for purposes of commercial resale
• Share account credentials with third parties or create accounts on behalf of others

8.3 Compliance with Laws

You are solely responsible for ensuring that your use of the Service and Generated Images complies with:

• All applicable federal, state, and local laws and regulations
• Fair housing laws and anti-discrimination regulations
• MLS rules and disclosure requirements specific to your jurisdiction
• Real estate licensing requirements and professional standards
• Advertising and marketing laws, including truth-in-advertising requirements

8.4 Enforcement

We reserve the right, but have no obligation, to:

• Monitor or review User Content for violations of these Terms
• Remove or refuse to display User Content that violates these Terms or applicable laws
• Suspend or terminate accounts that violate these Terms
• Cooperate with law enforcement authorities regarding illegal activities
• Take appropriate legal action against users who violate these Terms

Violation of this Acceptable Use Policy may result in immediate termination of your account and forfeiture of any unused credits without refund.

9. Third-Party Services and APIs

The Service relies on third-party services including Google Gemini API, Firebase, Stripe, Vercel, and Neon PostgreSQL. Your use is subject to their terms and privacy policies. We are not responsible for third-party service availability or performance.

12. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI-generated images may not perfectly preserve room structure, lighting, or perspective. Generated images may contain artifacts or imperfections. You are solely responsible for MLS compliance and accurate property representation.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID IN THE PRECEDING 12 MONTHS OR $100, WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

16. Dispute Resolution and Governing Law

These Terms are governed by Texas law. Disputes will be resolved through binding arbitration administered by the American Arbitration Association in San Antonio, Texas. Class action waiver applies.
